This is a legal agreement between you (either an individual or an entity), the end user, and the software licensors. By installing this software you have agreed to be bound by the terms of this agreement, which follow:
This License Agreement permits you to use the QPSMR CL program (the "SOFTWARE") on the number of computers stated in your contract and invoice. This software is licensed only for use at the site detailed in [Help] [About this version].
The SOFTWARE is owned by NetMR Scotland Limited ("NETMR") and is protected by copyright laws.
Therefore, you must treat the SOFTWARE like any other copyrighted material (e.g., a book or musical recording) except that you may make one copy of the SOFTWARE solely for backup or archival purposes.
You may not copy the written materials accompanying the SOFTWARE without the permission of the authors.
You may not alter the SOFTWARE executable programs (*.exe or *.dll) in any way.
The licensor warrants that the SOFTWARE will perform substantially in accordance with this help file for a period of ninety (90) days from the date of receipt. Any implied warranties on the SOFTWARE are limited to ninety (90) days. Nothing herein shall be taken to abrogate the statutory rights of a customer pursuant to law.
NETMR and its dealer's entire liability and your exclusive remedy shall be, at the licensor’s option, either
(a) Return of the price paid or
(b) Repair or replacement of the SOFTWARE that does not meet the limited warranty and which is returned to the vendors with a copy of your receipt.
This limited warranty is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication.
Any replacement SOFTWARE will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.
To the maximum extent permitted by applicable laws, NETMR and its dealers disclaim all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose and quality of service, with regard to software and the accompanying written materials.
To the maximum extent permitted by applicable laws, in no event shall NETMR or its dealers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use this product, even if NETMR or its dealers have been advised of the possibility of such damages.
This agreement shall be governed by UK law and you agree that any dispute relating to this agreement must be dealt with in the UK according to the laws of the UK.
